| PRBoA SUES Sec. Ebdane, PICE, et.al. At 2:45 p.m. of Thursday (05 November 2009), the PRBoA SUED former DPWH Secretary EBDANE, 2 of his Undersecretaries, the Phil. Inst. of Civil Engineers (PICE), the accredited professional organization (APO) of Phil. civil engineers and law book publisher Atty. Vicente B. Foz.
Atty. Foz is the listed publisher of the inaccurate version of P.D. No. 1096, the 1977 National Building Code of the Phils./ NBCP being sold at National Bookstore branches nationwide, which purports that civil engineers can sign and seal ARCHITECTURAL plans/ documents such as perspectives floor plans, sections. elevations, roof plans, finish schedules and architectural details of all buildings sited on Phil. soil.
The Respondents are being charged for violations of Anti-Graft laws (R.A. Nos. 3019 and 6713) relative to their NON- implementation and NON-enforcement of R.A. No. 9266 (The Architecture Act of 2004) and of P.D. No. 1096 and their respective implementing rules and regulations (IRR).
The PRBoA is currently preparing a separate Ombudsman complaint against LGU officials who similarly refuse to implement and enforce R.A.No. 9266.
The public particularly national and local government officials, are warned NOT to commission or deal with unregistered persons to prepare, sign and seal ARCHITECTURAL documents, which by law are acts reserved ONLY for Registered and Licensed Architects (RLAs). The definition of unregistered persons include civil engineers and foreign architects, who must secure a temporary/ special permit (TSP) to practice in the Phils.
Private individuals who hire unregistered persons i.e. non-RLAs to do works of architecture run the risk of being criminally charged under R.A. No. 9266, which prescribed stiff penalties for such acts.
